Gunman and his victim both shot during robbery attempt

CHARLOTTE, NC (WBTV) - Two men are shot, one is fighting for his life after a botched robbery in east Charlotte.

Charlotte-Mecklenburg police raced to the scene and found two men shot at the Magnolia Square Apartments on Eastway Drive.

But who these people were turned out to be something they weren't expecting.

Officers said around 11:00 Wednesday, two Hispanic men were walking through the parking lot of the complex, when a black SUV raced up beside them.

Two gunmen jumped out, and tried to rob the victims.

A struggle ensued, with all four men wrestling for control of the firearm.

Jose Alberta Amaya, the 52-year old man who was being robbed, managed to twist the weapon and shoot the assailant twice, striking him in the head and chest.

The victim was also shot in the hand.

When the gunfire started, the second robbery suspect jumped back in the SUV, and took off. He is still at large.

The CMPD said Medic rushed both men to Carolinas Medical Center. The victim is expected to make a full recovery.

That may not be the case for the gunman.

At last word, he was in surgery with life-threatening injuries.

Crime scene investigators were called out to the scene, where an handgun was recovered.
