CHARLOTTE, NC (WBTV) -

A driver has been charged with DWI in a northeast Charlotte crash that killed a man early Friday morning.

The crash happened around 1:48 a.m. on N. Tryon Street at Austin Drive. Charlotte-Mecklenburg police say 23-year-old Benjamin James was driving a 2013 Dodge Challenger at a high rate of speed when he lost control and drove off the side of the road, striking a fence and a tree.

"After impact with the tree, the vehicle rotated into a telephone pole coming to rest on its roof on Austin Drive," police say.

Police arrived to find the Dodge on its roof. Medic pronounced the front passenger, who was later identified as 23-year-old Curtis E. Saunders, dead on scene. James went to Carolinas Medical Center with serious injuries.

James was charged at the hospital with Driving While Impaired.

Several lanes surrounding the crash scene were closed for some time.
