CHARLOTTE, NC (WBTV) - A 28-year-old man is accused of publicly urinating from his seat while on an overnight flight to Charlotte over the weekend.

According to a federal affidavit filed by the FBI, Jordan Gardner was on board an American Airlines flight from San Francisco to Charlotte that landed early Sunday morning.

About an hour into the flight, Gardner reportedly pulled down his pants, arched his back and urinated on the floor of the airplane. A flight attendant was notified and Gardner was sent to the plane's bathroom.

The flight attendant attempted to clean up the mess with some club soda, according to the affidavit. About 15 minutes later, she found Gardner passed out in the bathroom. He was then put back in his seat.

When the plane landed, Gardner was interviewed and arrested by the FBI. He told officials he had two double shots of vodka at the San Francisco airport. Investigators say they could still smell the alcohol on him eleven hours later.

He reportedly told investigators that the smell may have been coming from his chewing gum. He couldn't remember urinating on the plane, passing out in the bathroom, or the flight from San Francisco to Charlotte, according to the affidavit.

Gardner told investigators someone may have put something in his drink - or that he had a memory problem.

"Gardner told law enforcement officer that if being truthful will get him into trouble, he will tell them what will get him on the road," the affidavit reads.

He's being held as a federal prisoner at the Mecklenburg County Jail.

He reportedly has a criminal history that involves battery, trespassing, auto theft, passing bad checks, vandalism and being under the influence.
