Waxhaw town board votes mayor of a certain duties

There were some tense moments Tuesday night as Waxhaw's mayor, who's been under investigation before, was voted out of one of her leadership positions.

The Waxhaw Board of Commissioners believes Mayor Daune Gardner wasn't fulfilling her duties. So they took her off the local transportation board, but she's fighting it. 

Mayor Gardner's chair was empty as the meeting, scheduled to discuss her recent fine by the state's ethics commission, kicked off. However, not a minute after they started, Gardner walked in. 

Mayor Pro-Tem Michael Stewart called the special meeting because he says Gardner shouldn't be allowed to serve on the Charlotte Regional Transportation Planning Organization.

"You can play the innocent victim mentality if you'd like to, the truth is there's a documented history of inabilities to perform duties," Stewart said. 

As a member of the CRTPO, Gardner is required to submit a statement of economic interest, but admits she's being fined 250 dollars because she sent it in late. 

"I'm as perplexed as anyone, I filed some paperwork late and like I said we all have," Gardner said. 

The board voted 4-1 to remove her.  They say it's because her paperwork was late. However, many question other factors like Gardner pleading guilty to a DWI in 2013. Another DWI charge was expunged in 2008.

"I can't speak to what motivation or intent may have been apart of this," Gardner said. 

Despite the vote, Gardner says she is still on the board until she hears otherwise. She insists the commissioners do not have the authority to vote her out. Mayor Pro-Tem Stewart says otherwise.
