Police: Death of 13-year-old could be mistaken identity

CARROLLTON, GA (CBS46) -

Police are looking for a person of interest in connection with the death of a 13-year-old boy who was shot in the head on Saturday.

On Monday, police arrested and charged Malik Davis, 17, with murder.

Police believe Davis retaliated after he got into a fight with three people at the West Side Bar & Grill early Saturday morning.

"I saw Malik standing right there. They dashed a cup in his face. He was wiping his eyes and then they all started fighting against the car right here and at the end there was a little bit of blood," said restaurant manager Anita Reddish.

Reddish said the fight was intense.

"One girl got a screwdriver. She was trying, like she was trying to stab somebody," said Reddish.

She said police told her Davis left her establishment and asked someone to drop him off at the Bristol Lake Apartments.

Officers believe Davis mistakenly entered the wrong apartment and shot Nizzear Rodriguez while he slept.

Police said Davis may have had someone else with him when he entered the apartment.

"The people who were fighting Malik, they do live in that complex," said Reddish.

Nizzear, who had just turned 13 the day before, slept under a loud fan.

His grandmother and uncle slept in nearby rooms with the TV volume up, so they never heard the shot.

Now Reddish wants justice for Nizzear.

"He was at my house two weeks ago, spent the night with my kids, stayed about three days. The sweetest kid you'll ever meet," said Reddish.

Nizzear's family hopes to have funeral arrangements finalized by Tuesday.
