NC continues fight against bail in murder case

Posted: Updated:

RALEIGH, N.C. (AP) - North Carolina's Supreme Court is temporarily blocking the release on bail of a man a judge described as probably innocent despite nearly 20 years in prison on a marred double-murder conviction.

The state Supreme Court on Wednesday ordered that the effort to free 52-year-old Darryl Howard from prison stay on hold.

Howard wants to be freed while prosecutors try to reverse a May ruling by Superior Court Judge Orlando Hudson throwing out Howard's conviction.

Hudson ruled that authorities withheld evidence during Howard's 1995 trial that could have exonerated him and that he must be retried. The judge ruled evidence recently surfaced showing possible misconduct in the case by a Durham detective and former Durham prosecutor Mike Nifong, who was disbarred after the Duke lacrosse case.
