Alleged child porn ringleader not on sex offender registry

The man at the center of a child porn investigation at an Eastern North Carolina daycare is nowhere on the state's sex offender registry site. Bailey Joe Mills was convicted twice before dating back to 1997, and thanks to a 2006 state law, a judge took him off the registry.

"Had this person committed a crime after 2001, then he would have been on the sex offender registry for life," Attorney General Roy Cooper told affiliate WRAL.

Cooper says Mills' convictions were before legislators passed a 2001 law that keeps repeat offenders on the registry until they die.

In 1997, a jury convicted Mills with indecent liberties with a child. He was given probation. Three years later in 2000 Mills was again convicted for the same charge.

Records show in 2011, Mills submitted a formal petition to be removed from the list. According to WRAL, a judge granted that request, deciding Mills was not a current or potential threat to public safety.

Detectives say Mills found men online willing to pay to have sex with the children. Authorities say there are 10 victims between the ages of one and 14 years old.

Four other people are also charged in connection with the alleged operation, and Mills now faces more than a dozen other charges, including five counts each of statutory rape and statutory sexual offense and first-degree rape of a child.

Cori Goldstein is an advocate for sexual assault victims in Charlotte. She works with Safe Alliance, a nonprofit organization and she's familiar with the sex offender registry. Goldstein says Mills' removal from the list is frustrating, but parents should always have back up plans.

"The registry is not this magic force field that's going to protect everybody. People need to use as a tool but also think about other ways to keep themselves and their families' safe," she said.
