Sources: Off-duty deputy shoots, kills man attempting to rob Salisbury restaurant

A man was shot and killed while attempting to rob a Salisbury restaurant, according to officials.

The incident happened at the China Buffet on North Arlington Road, which is off of East Innes Street, around 9:05 p.m. Tuesday.

Officials said that an off-duty Rowan County Sheriff's Deputy, 41-year-old John L. Kempf, shot and killed a man that was attempting to rob the restaurant.

Officials said that the man was pronounced dead at the scene.

Kempf was hired by the Sheriff's Office in May 2013, and was assigned to the Rowan County Detention Center. He is currently in a probationary status, since he has been employed by the department for less than a year.

Investigators said the gun Kempf used to shoot the alleged robber was his Rowan County issued Glock.

The Sheriff's Office said Wednesday that evidence they have reviewed "leads our office to conclude that Deputy Kempf acted in a manner consistent with his training and the laws of the State of North Carolina."

Police officers with guns drawn were walking through the parking lot and searching workers leaving the restaurant after the shooting.

The State Bureau of Investigation is investigating the incident. The Rowan County Sheriff's Office also came to the scene to assist Salisbury Police.

Officials have not released the name of the man who was killed.
