Sources: Trooper, deputy shot at outside Union Co. convenience store

Investigators in Union County said a trooper with the NC Highway Patrol and a deputy with the Union County Sheriff's Office were shot at during an altercation at a convenience store Wednesday morning.

The incident was reported at Potter Road and Chestnut Lane in Indian Trail, according to law enforcement officials.

The trooper and the deputy were not injured. But when the call came in the Union County Sheriff said he didn't know.

"It's scary when that phone rings at 4:30 in the morning and it's a shooting involved," said Sheriff Eddie Cathey, "You're wanting to check on your officers be sure they're alright and the subject is alright. It's pretty nerve racking."

The Circle K near the intersection of Chesnut Lane and Potter's Road in Indian Trail was filled with law enforcement before the sun came up. The Union County Sheriff's Office said 20-year-old James Eric Sims walked into the store trying to buy beer and the clerk refused because of the time.

That clerk told Trooper W.L. Winchester, who was on regular rounds, what had happened and Sims started to argue with the Trooper. The Trooper called for back up and Deputy K.C. Ciucevich was first to arrive on the scene a few minutes later.

The two officers checked outside that Sims had left and found Sims with a gun on the side of the store. Sims shot multiple times and they returned fire. No one was hit.

Sims ran and was later found close by and arrested. He's facing multiple charges, including possession of a firearm by a felon. He was taken to jail without bond.

His preliminary court date has been set for April 29, in Union County District Criminal Court.
