Three people inside a Shelby home were unharmed after a man fired a shot at one of the bedroom windows.

Shelby Police responded to 106 Seaboard Ave just before 6:30 a.m. Saturday. A caller told police the home was shot into and then the alleged shooter took off in a truck. The truck was found wrecked in front of the home.

Kayla Scott says she, her fiance and his mother were inside the home at the time.

Scott say she was asleep when bright lights outside woke her up.

"I said My Lord there shouldn't be anybody out there this time of morning," Scott said.

Scott says she looked out the window to see a man fire a gun at her mother-in-law's bedroom window. "I just heard my window break," Wanda Bowen said.

"He [the alleged shooter] seen me, he got in the truck real fast," Scott said.

The suspected shooter didn't get far. The truck he was riding in wrecked and rolled down an embankment. He was thrown out and killed. The driver, 42-year-old Richard Ray Martin was led away in handcuffs.
Police charged Martin with DWI and felony death by vehicle. He's being held in the Cleveland County Detention Center under a $250,000 bond.

Scott says she knows the suspected shooter but does not know Martin. Police haven't released a motive or the name of the alleged shooter pending notification of his family.  "I really don't know why he was upset and what would make him do that," Scott said of the suspected shooter.

Police say the case is still under investigation with further charges pending.
