Homeowner shoots man who defecated near his home

PHOENIX (CBS5) -

A 26-year-old man is in stable condition after being shot by a Phoenix homeowner.

Phoenix Police Department spokesman Sgt. Tommy Thompson said the 61-year-old homeowner was checking around his property in the area of 700 W. Buchanan St. shortly after midnight on Friday when he found the 26-year-old man sleeping right outside the fenced area of his home and business.

The homeowner told the man to leave. After the man left, the homeowner said he found feces close to where the man had been and told him to clean it up, but the younger man walked away.

The homeowner followed the man, and a fight ensued near the railroad tracks and Ninth Avenue. The younger man swung a chain with a padlock at the homeowner, according to police. The homeowner fell on the ground, and then he fired a shot, missing the man before firing a second shot in his chest.

The younger man was taken to the hospital. He is expected to survive.

Thompson said the case is ongoing, and when it's completed it will be sent to the Maricopa County Attorney's Office for review.
