Bill clarifies law on murder charge in North Carolina

RALEIGH, N.C. (AP) - The General Assembly has finalized a bill making clear North Carolina authorities can charge someone with murder for the death of a child caused by injuries that occurred while in the womb but whose death occurred after delivery.

The House approved the measure unanimously Tuesday, a day after the Senate also agreed to the legislation, which now goes to Gov. Pat McCrory's desk.

The bill says the measure confirms common law that was challenged in part during the case of a man convicted of first-degree murder in the death of his daughter a month after her delivery in 2008. An appeals court upheld the man's conviction.

A 2011 law allows prosecutors to charge someone accused of causing a fetus to die or injuring it inside the womb.
