A suspect facing charges for allegedly raping a Miami University student during a burglary has filed a motion for a new trial.
Police believe Fransisco Jairo Naupa Rivera is responsible for entering five houses belonging to Miami students.
Rivera was originally charged with burglary, aggravated burglary and rape after being found by police inside a residence where he allegedly raped a woman in her bedroom. Additional charges were later added of two counts of criminal trespass and one count each of burglary and attempted theft.
Rivera previously accepted a plea deal in the case. Following the deal, he hired new representation. Rivera's new attorney filed a motion for a new trial, claiming Rivera didn't understand his plea agreement.
On Wednesday, no decision was made about the new trial and another hearing is scheduled for April 5th.
