Former UNC student body president's killer to be resentenced

RALEIGH, NC (WBTV) -

The N.C. Court of Appeals threw out the life sentence of one of the two men convicted in the 2008 killing of UNC Student Body President Eve Carson.

Laurence Alvin Lovette, 22, was found guilty of first degree murder and sentenced to life in prison.

On Tuesday, the state court of appeals ruled that because Lovette was under 18 at the time of the murder, he had to be sentenced as a juvenile, and his current sentence of life in prison without parole was unjust.

Carson was found dead about a mile from campus in March of 2008. The autopsy report revealed her body had been shot several times, including once in the head.

Demario Atwater, 26, was also charged and sentenced to prison time. He was 22 at the time of the killing.

Lovette will have to have a new sentencing hearing where the court will decide a new sentence for the first degree murder charge.
