The five siblings removed from an East Texas home after their brother was found dead in a septic tank are one step closer to a permanent home.
Two-year-old Jake Kimbley's siblings have been in foster care since August.
Jake Kimbley was found dead in a septic tank on his family's property early on the morning of August 22. His siblings were removed from the home by court-order the same day, citing concerns about the sanitation of the home.
A lawyer for one of the children confirms that an aunt of the children has had a home-study approved by CPS. However, before the children are placed in the home, CPS has asked for a therapeutic recommendation to be conducted. The lawyer says there are "minor concerns" about a relative in the home using depression medication and whether that medication would have an effect on raising the children.
CPS will review the therapeutic recommendation and make a recommendation to Smith County 321st District Judge Carole Clark about whether the children should be placed in the aunt's home.
CPS is expected to make a recommendation to Judge Clark before the children's next hearing, which will take place in February 2013.
