Motion filed to overturn indictment for teen charged with murder

BATON ROUGE, LA (WAFB) -

The attorney for a teenager charged with murder in the death of an 8-year-old boy has filed a motion to overturn the indictment.

Lewis Unglesby represents Trevor Reese, 17, who is accused of slashing the throat of Jackson Attuso of Clinton.

Unglesby argues a recent US Supreme Court decision on juvenile sentencing is grounds for the motion.

A grand jury indicted Reese for first-degree murder, but he will not face the possibility of the death penalty.

If convicted, he will receive an automatic life sentence.

Reese has pleaded not guilty by reason of insanity.

The case is set to go to trial next month.

Attuso was killed on a bike path in the The Bluffs subdivision in West Feliciana Parish on June 10, 2010.

Reese was 16 years old at the time.

A judge ruled the teen will be tried as an adult.

He has been held in the West Feliciana Parish Prison since his arrest on the day of the murder.

According to authorities, Reese stabbed Attuso to death while the young boy was riding his bike through the woods with his mother.
