Deputies say no charges will be filed against a Chester County man after he shot and killed his son at the home they shared.

According to Sheriff Richard Smith, deputies were called to a home along the 4400 block of Grier Drive in Edgemoor on Monday night around 7:04 p.m. to the report of a shooting.

Deputies were told by 911 operators that the reported shooter was still inside the home.

When they got to the home, deputies say, they found 72-year-old John C. Cherry sitting outside in a chair; the body of his son, 50-year-old Marvin D. Cherry, was lying on the ground. Cherry had died from an apparent gunshot wound.

John Cherry was identified as the shooter, deputies say.

During the investigation, deputies learned the pair lived together on Grier Road where the shooting happened.

After consulting with Doug Barfield the 6th Circuit Solicitor about this incident, no charged were filed against John Cherry at this time.

The case is still under investigation and the Sheriff's Office is waiting on autopsy results, Sheriff Smith told WBTV.
