SAWMILLS, NC (WBTV) - The driver of the van that hit a school bus head on was intoxicated when he got behind the wheel, troopers say.

Jay Fenner, 49, is charged with driving while impaired, driving while licensed revoked, driving left of center and reckless driving, according to the N.C. Highway Patrol.

Fenner was airlifted to Carolinas Medical Center-Main from the scene of the crash in Caldwell County Friday morning.

County school bus #117 was hit on U.S. Highway 321-Alternate at Baker Circle after Fenner crossed the center line around 9:15 a.m., said Caldwell County Schools spokesperson Libby Brown.

Brown said eight special needs students and a Teacher's Assistant were on their way to South Caldwell High School at the time of the incident.

None of the students were injured in the crash, and the driver of the bus and T.A. were taken to Caldwell Memorial Hospital for observation. They are expected to be okay.

Several Caldwell County school administrators were on scene investigating the cause of incident along with the N.C. Highway Patrol.

According to Brown, sheriff's deputies and school administrators said at least one person from the van was airlifted to Carolinas Medical Center-Main in Charlotte.

Fenner is listed in critical condition at CMC-Main on Monday.

The condition of the second passenger in the van is unknown.
