Witness in Marcus Jackson case faces deportation

CHARLOTTE, NC (WBTV) - Three months after he was arrested by an alleged dirty cop, Abel Moreno faces deportation charges.

Moreno called 911 back in December when he allegedly saw Marcus Jackson, a Charlotte-Mecklenburg Police officer, fondling his girlfriend during a traffic stop.

Jackson arrested Moreno for resisting arrest, but Moreno was later released when police discovered Jackson had allegedly sexually assaulted several woman while in uniform.

Moreno, a Mexican immigrant, who is in the country illegally was told he would not face deportation since his testimony would be crucial in the case against Jackson.

Last month, immigration officials came looking for him when Moreno missed a deportation hearing.

His attorney says the paperwork went to the wrong address.

"He missed the court date because he didn't know when it was and he was ordered removed from the country," said Rob Heroy, Moreno's Attorney.

Immigration officials acknowledged the mix up and rescheduled his deportation hearing for May 6.

Heroy is trying to obtain a U-Visa for Moreno, which would allow him to stay in the country at least three more years to help in the investigation.
